NOTICE OF PUBLIC HEARING ON DRAFT NDPDES PERMIT

April 14, 2003

PURPOSE OF PUBLIC NOTICE

THE DEPARTMENT INTENDS TO ISSUE A NORTH DAKOTA POLLUTANT DISCHARGE ELIMINATION SYSTEM (NDPDES) DISCHARGE PERMIT UNDER THE AUTHORITY OF SECTION 61-28-04 OF THE NORTH DAKOTA CENTURY CODE. IN ADDITION, THE DEPARTMENT WILL HOLD TWO PUBLIC HEARINGS TO SOLICIT COMMENTS PRIOR TO FINALIZING PERMIT CONDITIONS UNDER AUTHORITY OF SECTION 61-28-04 OF THE NORTH DAKOTA CENTURY CODE.

The application is for a temporary (intermittent) discharge of surface water from West Bay of Devils Lake to the Sheyenne River. The purpose of the project is to remove water from Devils Lake, to reduce damages around the lake, to reduce the risk and possibly prevent a natural overflow, and to maintain water quality standards. The discharge from the diversion system enters the Sheyenne in the SW 1/4 of the SE 1/4, Section 8, Township 151 N, Range 68 W. The recommended expiration date is June 30, 2008.

STATE TENTATIVE DETERMINATIONS

Tentative determinations relative to effluent limitations and other permit conditions have been made by the Department. They assure that State Water Quality Standards and applicable provisions of the FWPCAA will be protected.

HEARING PURPOSE AND LOCATION

Two public hearings will be held to solicit comments on the proposed permit and seek additional input on any concerns prior to finalizing this discharge permit. The department has scheduled one public hearing to be held in Devils Lake and the second hearing in Valley City.

One public hearing will be held on May 20, 2003 at 2:00 p.m. at the following location:

The second public hearing will be held on May 21, 2003 at 2:00 p.m. at the following location:

Valley City State University / Vangstad Auditorium
101 College Street SW, Valley City ND 58072-4098

PUBLIC COMMENTS

Written comments should be directed to the North Dakota Department of Health, Division of Water Quality, 1200 Missouri Avenue, Rm. 203, PO Box 5520, Bismarck, ND 58506-5520 or submitted online. All comments received by close of the hearing on May 21, 2003, either written or recorded during the scheduled public hearings, will be considered prior to finalizing the permit requirements.
